GuideToLenders.com ("GTL") is a website owned and operated by Quinstreet Media, Inc. QuinStreet Media, Inc. and its affiliated companies, including QuinStreet Properties, Inc., a California corporation, use GTL as the site of a virtual marketplace where interested consumers can be made aware of lenders and mortgage brokers who are seeking the opportunity to do business with people like them living in their area. QuinStreet Media, Inc. is a California corporation with its corporate headquarters in Foster City, California. QuinStreet Properties Inc. is a California corporation with its headquarters in Foster City, California. In the remainder of this document QuinStreet Media, Inc. and all of its affiliated companies engaged in the services provided via GTL are referred to collectively as QuinStreet Media.
QuinStreet Media does not make loans or make any credit decisions in connection with loans. QuinStreet Media does not issue loan commitments or lock-in agreements. QuinStreet Media is not an agent of either you the consumer or of any participating bank, lender or mortgage broker (referred to in the rest of this document as "Lenders"). QuinStreet Media Inc. provides administrative and marketplace services only. You must rely on your own judgment in deciding which available loan product best suits your needs and financial means and whether or not to work with any Lender of which you become aware via GTL. You are under no obligation to use GTL or QuinStreet Media to begin any financing process. QuinStreet Media does not guarantee that submitting requested information on GTL will result in the origination of a loan from a Lender. The information you submit to Quinstreet Media is NOT an application for credit. Quinstreet Media merely provides your information to certain lenders so that they may contact you directly. QuinStreet Media cannot guarantee that you will receive a loan with the most advantageous rate or terms or that better rates and terms are not available from Lenders in your area not participating in the GTL marketplace.
You will have to complete an application with a Lender before they will extend an unconditional loan offer. The Lender you select may require you to pay an application fee to cover the costs of an appraisal, credit report or other items. The Lender will determine the amount of any such fees. The Lender must provide you with certain information regarding whether any such fees are non-refundable. QuinStreet Media does not charge you, the consumer, any fees for its services. QuinStreet Media receives its compensation directly from Lenders for the services provided. QuinStreet Media's compensation may vary, but will never exceed $200.00 per lead.
QuinStreet Media Inc. will forward the information you provide to certain Lenders. These Lenders must make certain disclosures to you as required by the Federal Truth In Lending Act (TILA), the Real Estate Settlement Procedures Act (RESPA) and other federal and state laws. These disclosures include details of your cost of credit, good faith estimates of your settlement costs, certain HUD mandated booklets, notice that your mortgage loan servicing may be transferred and your right to a copy of any appraisal performed on your home. The Equal Credit Opportunity Act prohibits creditors from discriminating against credit applicants on the basis of race, color, religion, national origin, sex, marital status, age, because all or part of the applicant's income derives from any public assistance program, or because the applicant has, in good faith, exercised any right under the Consumer Credit Protection Act. The Federal Trade Commission administers compliance with these laws and may be contacted at: The Federal Trade Commission, Equal Credit Opportunity, Washington, D.C. 20580. The foregoing requirements are mandatory for Lenders, however Quinstreet Media makes no representations as to the adequacy or compliance on behalf of any Lender.
State Disclosures and License Information
Certain States may require QuinStreet Media to obtain a license in order to provide these services within their state. Other States may not. Some States may require additional information disclosures be given to you in connection with the provision of these services. QuinStreet Media reserves the right to refuse to accept or use the information you provide if such acceptance or use would constitute a violation of law or the terms and conditions of use for the GTL site www.guidetolenders.com. The following statements provide information that may be applicable to you if you reside in, or are considering the purchase of property in one of the listed States.
State mortgage regulators launched the Nationwide Mortgage Licensing System (“NMLS”) in January, 2008 to provide centralized and standardized online license management. The process of transitioning each state’s mortgage licensees to the NMLS has continued since the launch with the assignment of Unique Identification Numbers to facilitate licensee oversight and accountability. If the information you submit is forwarded to a Lender and that Lender subsequently makes you an offer, then Lender must provide to you a good faith estimate required under RESPA and an initial disclosure statement required under TILA within three business days from the date you submit an application with the Lender.
If the Lender denies your request for credit, and that action is based in whole or in part on any information contained in a consumer credit report, you have the right to obtain, within sixty days, a free copy of your consumer credit report from the credit reporting agency which compiles and maintains files on consumers on a nationwide basis. You also have the right to dispute the accuracy or completeness of any information in a consumer credit report furnished by the consumer credit reporting agency by contacting that agency directly.
An applicant, if married, may apply for a separate account.
Mortgage Fee Disclosure
QuinStreet Properties Inc. will receive a fee of between $4.00 and $200.00 from potential and actual Lenders for its services.
QuinStreet Properties Inc. will receive these fees whether or not you close your loan with any specific Lender. This amount is the total amount QuinStreet Properties Inc. receives, and Lenders pay this fee directly to QuinStreet Properties Inc. outside of closing. You, the consumer, acknowledge that these fees will be paid to QuinStreet Properties Inc. outside of closing, and that there is no other mortgage broker fee agreement between us.
The Housing Financial Discrimination Act of 1977 Fair Lending Notice It is illegal to discriminate in the provision of or in the availability of financial assistance because of the consideration of:
- Trends, characteristics or conditions in the neighborhood or geographic area surrounding a housing accommodation, unless the financial institution can demonstrate in the particular case that such consideration is required to avoid an unsafe and unsound business practice; or
- Race, color religion, sex, marital status, national origin or ancestry.
It is illegal to consider the racial, ethnic, religious or national origin composition of a neighborhood or geographic area surrounding a housing accommodation or whether or not such composition is undergoing change, or is expected to undergo change, in appraising a housing accommodation or in determining whether or not, or under what terms and condition, to provide financial assistance.

If the information you supplied to QuinStreet Media is forwarded to a Lender, the Lender may issue to you a Financing Agreement in accordance with D.C. Code Ann.§ 1113. If such a Financing Agreement is issued on a single to 4-family home to be occupied by the borrower the Lender must provide the following information:
(A) The term and principal amount of the loan; (B) An explanation of the type of mortgage loan being offered; (C) The rate of interest that will apply to the loan and, if the rate is subject to change, or is a variable rate, or is subject to final determination at a future date based on some objective standard, a specific statement of those facts; (D) The points and all fees, if any, to be paid by the borrower or the seller, or both; and (E) The term during which the financing agreement remains in effect.
If all the provisions of the financing agreement are not subject to future determination, change, or alteration, the financing agreement shall constitute a final binding agreement between the parties as to the items covered by the financing agreement.
The financing agreement executed by the Lender shall be delivered to the borrower at least 72 hours before the time of settlement agreed to by the parties.
A borrower aggrieved by any violation of this section shall be entitled to bring a civil suit for damages, including reasonable attorney's fees, against the Lender.
In Georgia, GTL marketplace services are provided exclusively by QuinStreet Properties Inc. pursuant to agreements with QuinStreet Media. QuinStreet Properties, Inc. is Georgia Residential Mortgage Licensee # 21664.

If the information you supplied is provided to a Lender, then that Lender must provide you with certain information pursuant to the Residential Mortgage License Act of 1987 and the Rules promulgated thereunder. QuinStreet Media does not make loans. Quinstreet Media will not collect any fee directly from you, the consumer. Quinstreet Media will be paid directly by potential Lenders, not by you the consumer. If QuinStreet Media makes false or misleading statements, you may, upon written notice, void this agreement, recover any monies you paid to QuinStreet Media for which no services have been performed, and recover actual costs including attorney's fees for enforcing your rights under this agreement. If you are contacted by a potential Lender you should be aware that:
- The responsibility of the attorney for the Lender is to protect the interest of the Lender.
- You may, at your own expense, engage an attorney of your own selection to represent your own interests in the transaction.
In addition to the above, if the Lender takes a loan application from you it is obligated to provide you the following information:
- The approximate expiration date of the note.
- The rate of interest charged.
- A statement that as of the expiration date of said note, the mortgagee may demand payment of said note, may rewrite the note by agreement at a greater or lesser rate of interest, or may, by agreement, allow payments to be made on said note at the same, or a lesser or a greater rate of interest.
The Federal Equal Credit Opportunity Act and comparable provisions of Massachusetts law prohibit creditors from discriminating against credit applicants on the basis of race, color, religion, creed, national origin, sex, sexual orientation, ancestry, handicap, marital status, age (provided that the applicant has the capacity to enter into a binding contract), or because all or part of the applicant's income derives from any public assistance program. In addition to the information provided to you as outlined above, the Lender must provide you with the following:
- a uniform one-page worksheet prescribed in regulations promulgated by the commissioner, written in plain and simple language, and including relevant examples, where necessary, which would allow you to calculate easily through simple arithmetic all the charges and fees that you are likely to incur in securing such mortgage from the mortgage lender.
- a copy of the most recent publication, currently entitled "Settlement Costs", available from the United States Secretary of Housing and Urban Development which describes information concerning the nature and costs of real estate settlement services.
- in the case of a first mortgage lender offering variable rate residential mortgage loans, not otherwise subject to Administrative Bulletin 13-2C (Revised) of the commissioner and, provided that the prospective mortgage borrower has requested information about or has submitted an application for a variable rate mortgage loan, a copy of the most recent publication available from the Federal Home Loan Bank Board which describes information concerning variable or adjustable rate mortgages, currently entitled "Consumer Handbook on Adjustable Rate Mortgages".
- a uniform model disclosure statement prescribed in regulations promulgated by the commissioner, written in plain and simple language, to aid prospective mortgage borrowers in understanding the mortgage application and approval process. The statement shall include descriptions of the time periods generally required for processing of mortgage applications, the notices required by Massachusetts law and by the Federal Equal Credit Opportunity Act.

You have the RIGHT to ask your mortgage broker to explain exactly what the mortgage broker will do for you. 6. You have the RIGHT to know how much the mortgage broker is getting paid by you and the lender for your loan. 7. You have the RIGHT to ask questions about charges and loan terms that you do not understand. 8. You have the RIGHT to a credit decision that is not based on your race, color, religion, national origin, sex, marital status, age, or whether any income is derived from public assistance. 9. You have the RIGHT to know the reason if your loan application is turned down. 10. You have the RIGHT to receive the HUD settlement costs booklet “Buying Your Home.
If a Lender requests that you fill out an application for a mortgage loan, which Lender shall provide you with the following additional notice:
CONSUMER CAUTION AND HOME OWNERSHIP COUNSELING NOTICE
If you obtain this loan, the lender will have a mortgage on your home. You could lose your home, and all money you have invested in it, if you do not meet your obligations under the loan, including making all your payments. Mortgage loans rates and closing costs and fees vary based on many factors, including your particular credit and financial circumstances, your earnings history, the loan-to-value requested, and the type of property that will secure your loan. Higher rates and fees may be applicable depending on the individual circumstances of a particular consumer's application. You should shop around and compare loan rates and fees.
